If you are planning to rent a property in Spain – whether an apartment, house, or villa – it’s important to understand the key legal and practical details.

1. No Agency Commission for Tenants
If you hire a real estate agent in Spain, you do not pay any agency commission provided the rental contract has a duration of more than 12 months.
2. Deposit for Furnished Properties
When renting a furnished property, the security deposit is usually equivalent to two months’ rent.
For unfurnished apartments, the standard deposit is one month’s rent.
3. Deposit Amount May Vary
For unfurnished properties, the deposit is normally one month’s rent, but depending on the landlord and the property, it may range from two to six months’ rent.
4. Refund of the Deposit
The deposit must be refunded within 30 days after the end of the rental period, provided no damages are found in the property.
5. Utility Costs
Electricity, water, and gas bills are generally paid by the tenant.
These utility contracts should be transferred into the tenant’s name.
6. Good Properties Rent Quickly
Please note that properties offering good value for money are often rented within just a few days.

7. Timing Your Property Search
Your property search should not begin earlier than four weeks before your planned arrival or viewing, as many properties may already be rented by that time.

Once you have moved into your new home, all further communication takes place directly between the tenant and the landlord.
